Terms of Service
Updated On 10/29/2026
Welcome to the website of Smith's Landing Seafood Grill ("Smith's Landing," "we," "us," or "our") at www.smithslandingantioch.com (the "Site"). These Terms of Service ("Terms") govern your use of the Site and the services we offer through it, including reservations, online ordering, gift cards, event tickets, pre-orders, private dining inquiries, job applications, and our newsletter.
Please read these Terms carefully. By using the Site, you agree to these Terms and to our Privacy Policy, which explains how we handle your information. If you do not agree, please do not use the Site.
1. Use of the Site
The Site provides information about our restaurant, including menus, hours, location, events, and private dining, and gives you ways to reserve a table, order food, buy gift cards and event tickets, apply for a job, and contact us.
You may use the Site only for lawful purposes and in accordance with these Terms. You must be at least 18 years old to make a purchase or reservation through the Site. If you are under 18, you may use the Site only with the involvement of a parent or guardian.
You agree to provide accurate and complete information when you make a reservation, place an order, buy a gift card or ticket, or submit a form, and to keep that information up to date.
We want everyone to be able to use the Site. If you have difficulty accessing any part of it, please contact us using the details in Section 22 and we will help.
2. Menus, Prices, and Hours
We work to keep the information on the Site accurate, but menus, prices, hours, and event details change. Items shown on the Site may be seasonal, unavailable, or priced differently in the restaurant. Photos are for illustration and may not match a dish exactly as served. We may correct errors and change or discontinue any item, price, or offering at any time without notice.
If an item or ticket is listed at an incorrect price because of a typographical or system error, we may cancel the affected order and refund any amount you paid.
3. Food Allergies and Dietary Information
Menu descriptions are not complete ingredient lists. Our kitchen handles shellfish, fish, dairy, eggs, wheat, soy, tree nuts, peanuts, and other allergens, and we cannot guarantee that any item is free of a particular allergen. If you have a food allergy or dietary restriction, tell your server or contact us before ordering.
Consuming raw or undercooked seafood, shellfish, meat, poultry, or eggs may increase your risk of foodborne illness, especially if you have certain medical conditions.
4. Alcohol
We serve alcohol only to guests who are 21 or older. We may ask for valid government-issued photo identification and may refuse service to anyone at our discretion. Please drink responsibly.
5. Reservations
Table reservations are offered through OpenTable and are subject to OpenTable's terms of use. Reservations are subject to availability and to the booking policies shown when you reserve, including any party-size limits or large-party requirements. We may release your table if your party does not arrive within a reasonable time of your reservation, and we may cancel reservations that appear to be fraudulent or duplicated. If your plans change, please cancel or modify your reservation through OpenTable so we can offer the table to other guests.
6. Online Ordering
Online ordering is provided through ChowNow on ChowNow's website. When you place an order, you agree to ChowNow's terms and to pay the price shown at checkout, including any taxes and fees. Pickup times are estimates. If we cannot fulfill part of your order, we will contact you using the information you provided. Alcoholic beverages, where offered, may be ordered and picked up only by guests who are 21 or older with valid identification.
7. Gift Cards
Gift cards purchased through the Site are redeemable for food and beverages at Smith's Landing Seafood Grill. Gift cards do not expire and carry no fees. They cannot be redeemed for cash except where required by law; under California law, a gift card with a remaining balance of less than $10 may be redeemed for cash on request. Treat your gift card like cash. We are not responsible for gift cards that are lost, stolen, or used without your permission after delivery. Gift card purchases are processed by our website platform, BentoBox, and its payment processor.
8. Event Tickets and Pre-Orders
Event tickets and take-home pre-orders, such as holiday dinners, are sold through an online store run by Ecwid. The description, price, date, pickup window, and any refund or exchange terms shown at the time of purchase are part of your agreement with us. Unless stated otherwise at checkout, tickets and pre-orders are final sale and may not be refunded or exchanged. If we cancel an event, we will refund the ticket price. Pre-orders must be picked up during the window shown at checkout. We may refuse admission or service to anyone who is disruptive, intoxicated, or in violation of these Terms, without refund.
9. Payment
All prices are in U.S. dollars. Applicable taxes and any service or processing fees are shown at checkout. You agree to pay all charges made under your name or payment method. Payment card information is collected and processed by our payment processors, not by us.
10. Private Dining and Event Inquiries
Submitting a private dining inquiry through the Site is a request for information, not a booking. A private event is confirmed only when we agree in writing to the date, menu, pricing, and other terms, which may include a deposit and a separate event agreement.
11. Job Applications
Submitting an application through the Site does not create an offer of employment or an employment relationship. We are an equal opportunity employer. You represent that the information in your application is accurate and that you have the right to share any materials you upload.
12. Newsletter and Communications
If you sign up for our newsletter, you agree to receive emails from us about events, menus, and specials. You can unsubscribe at any time using the link in any email. When you contact us through the Site, you agree that we may respond by email or phone using the details you provide.
13. Intellectual Property and Your Submissions
The Site and its content, including text, menus, photographs, videos, logos, graphics, and design, are owned by Smith's Landing or our licensors and are protected by copyright, trademark, and other laws. The Smith's Landing Seafood Grill name and logo are our trademarks. You may view, download, and print pages from the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from Site content, or use our trademarks, without our prior written permission.
If you send us feedback, suggestions, or ideas through the Site, we may use them without any obligation to you. Personal information you submit is handled according to our Privacy Policy.
14. Acceptable Use
You agree not to:
- use the Site in any way that violates applicable law;
- make fraudulent reservations, orders, or purchases, or make reservations you do not intend to honor;
- submit false, misleading, defamatory, obscene, or infringing content through our forms;
- upload files that contain viruses or other malicious code;
- use bots, scrapers, or other automated means to access the Site or collect information from it, other than search engines operating in accordance with our robots instructions;
- attempt to gain unauthorized access to the Site, its servers, or any connected systems; or
- interfere with the operation of the Site or with other visitors' use of it.
We may block access to the Site for anyone who violates these Terms.
15. Third-Party Services and Links
The Site uses and links to services operated by other companies, including OpenTable (reservations), ChowNow (online ordering), Ecwid by Lightspeed (tickets and pre-orders), inKind (dining rewards), Google Maps, Facebook, and Instagram. Those services are governed by their own terms and privacy policies. We do not control them and are not responsible for their content, availability, or practices. Your use of them is at your own risk.
16. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses, or that information on the Site is accurate, complete, or current.
17. Limitation of Liability
To the fullest extent permitted by law, Smith's Landing and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of your use of the Site will not exceed the greater of the amount you paid us through the Site in the 12 months before the claim arose or one hundred dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be waived under applicable law, including California law.
18. Indemnification
You agree to defend, indemnify, and hold harmless Smith's Landing and its owners, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. If you have a dispute with us, please contact us first so we can try to resolve it informally. Any lawsuit relating to these Terms or the Site must be brought in the state courts located in Contra Costa County, California, or the United States District Court for the Northern District of California, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from bringing a qualifying claim in small claims court.
20. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.
21. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy and any terms shown at the time of a purchase or reservation, are the entire agreement between you and Smith's Landing regarding the Site. You may not assign your rights under these Terms. We may assign ours to a successor of our business.
